Этот документ объясняет, какие сведения о посетителях собирает сайт formabureau.com, зачем они нужны и что вы можете с ними сделать. Мы старались написать его человеческим языком, но он остаётся официальным: политика составлена в соответствии с Федеральным законом от 27 июля 2006 года № 152-ФЗ «О персональных данных».

1. Кто обрабатывает данные

Оператором персональных данных является индивидуальный предприниматель Усанов Иван Владимирович, ОГРНИП 308402514200073, ИНН 402506805163, адрес для направления корреспонденции: 191014, Санкт-Петербург, ул. Некрасова, д. 56, кв. 25.

По любым вопросам, связанным с обработкой ваших данных, пишите на hey@formabureau.com. Мы отвечаем в течение рабочего дня, а на официальные обращения — в сроки, установленные законом.

2. Какие данные собираются

Сайт не содержит форм регистрации, заказа или обратной связи. Мы не просим вас вводить имя, телефон или адрес и не собираем такие сведения автоматически.

Обрабатываются только те данные, которые браузер передаёт сам при обращении к страницам:

• IP-адрес, с которого пришёл запрос;
• сведения о браузере и операционной системе;
• адрес страницы, которую вы открыли, и адрес страницы, с которой перешли;
• дата и время обращения.

Эти сведения записываются в журналы веб-сервера. Отдельно от них, и только с вашего согласия, работает статистика посещаемости — о ней в разделе 5.

Если вы напишете нам на почту или в Telegram, мы получим ваш адрес, имя учётной записи и содержание сообщения. Эти данные вы передаёте нам добровольно, и обрабатываем мы их ровно для того, чтобы вам ответить.

3. Зачем это нужно

Журналы сервера нужны, чтобы сайт работал: чтобы отдать страницу вашему браузеру, заметить сбой и защититься от автоматических атак. Правовое основание — наш законный интерес в бесперебойной и безопасной работе сайта.

Статистика посещаемости нужна, чтобы понимать, какие работы смотрят и какие разделы оказались бесполезными. Правовое основание — ваше согласие, которое вы даёте, нажимая «Принять» в уведомлении при первом визите.

Переписка обрабатывается для ответа на ваше обращение и, если дело дойдёт до работы, для заключения и исполнения договора.

Мы не принимаем на основании этих данных решений, которые как-либо затрагивают ваши права, и не составляем ваших профилей.

4. Что хранится в вашем браузере

Собственных cookie сайт не устанавливает. Вместо них используется локальное хранилище браузера, и в нём лежат ровно две записи:

• forma_lang — выбранный вами язык, чтобы не переспрашивать при следующем визите;
• forma_cookies_ok — ваш ответ на уведомление о статистике.

Обе записи хранятся только на вашем устройстве и нам не передаются. Если вы согласились на статистику, Google Analytics установит собственные cookie — они описаны ниже.

Очистить всё это можно в настройках браузера, удалив данные сайта. Работоспособность страниц от этого не пострадает — сайт просто снова спросит про язык и статистику.

5. Статистика посещаемости

Для подсчёта посещений используется Google Analytics — сервис компании Google LLC (1600 Amphitheatre Parkway, Маунтин-Вью, Калифорния, США).

Скрипт статистики не загружается до тех пор, пока вы не нажмёте «Принять». Пока вы этого не сделали или нажали «Отклонить», к серверам Google не уходит ни одного запроса и никакие данные о вас туда не передаются.

Если вы согласились, Google Analytics получает обезличенный идентификатор вашего браузера, сокращённый IP-адрес, сведения о просмотренных страницах и об устройстве. Мы включили обезличивание IP-адреса — полный адрес до Google не доходит. Собранные сведения передаются и хранятся на серверах Google, в том числе за пределами Российской Федерации, и обрабатываются на условиях политики конфиденциальности Google.

Отозвать согласие можно в любой момент: удалите данные сайта в настройках браузера — уведомление появится снова, и вы сможете ответить иначе. Дополнительно можно установить официальное расширение Google, отключающее статистику на всех сайтах сразу.

6. Кому передаются данные

Мы не продаём и не передаём ваши данные третьим лицам, за исключением случаев, описанных ниже.

• Хостинг. Сайт размещён у компании Soluciones Corporativas IP, S.L. (DonDominio, Испания) — на её серверах ведутся журналы обращений.
• Статистика. Google LLC — только при вашем согласии и только в объёме, описанном в разделе 5.
• По требованию закона. Государственным органам, если они запросят сведения в порядке, установленном законодательством.

Никаких других получателей нет. Шрифты, изображения и скрипты сайт отдаёт со своего сервера, поэтому при обычном просмотре страниц ваш браузер никуда, кроме formabureau.com, не обращается.

7. Трансграничная передача

Серверы хостинга находятся в Испании, серверы Google — в США и других странах. Испания как участник Конвенции Совета Европы о защите физических лиц при автоматизированной обработке персональных данных обеспечивает адекватную защиту прав субъектов. Передача данных в США происходит только при вашем согласии на статистику; вы вправе его не давать, и сайт будет работать так же.

8. Сколько хранятся данные

• Журналы веб-сервера — не более 6 месяцев, затем удаляются.
• Данные статистики — 14 месяцев, после чего Google удаляет их автоматически.
• Переписка — пока она нужна для работы и ещё 3 года после последнего письма, если из неё возникли договорные отношения.
• Записи в вашем браузере — пока вы их не удалите.

Достижение цели обработки, отзыв согласия или ваше требование об удалении — основание уничтожить данные раньше указанных сроков.

9. Ваши права

Закон даёт вам право:

• узнать, обрабатываем ли мы ваши данные, и получить их копию;
• потребовать уточнить неточные или неполные данные;
• потребовать заблокировать или уничтожить данные, если они получены незаконно или больше не нужны;
• отозвать согласие на обработку;
• возражать против обработки;
• обжаловать наши действия в Роскомнадзоре или в суде.

Чтобы воспользоваться любым из этих прав, напишите на hey@formabureau.com. Мы ответим в течение 30 дней, а если потребуется больше времени — сообщим об этом и объясним причину. Мы можем попросить подтвердить личность, но лишь настолько, насколько это нужно, чтобы не выдать ваши данные постороннему.

Надзорный орган: Федеральная служба по надзору в сфере связи, информационных технологий и массовых коммуникаций (Роскомнадзор), rkn.gov.ru.

10. Как мы защищаем данные

Сайт работает по защищённому протоколу HTTPS. Внутренние разделы закрыты паролем. Доступ к серверу есть только у сотрудников бюро, которым он нужен для работы. Мы принимаем правовые, организационные и технические меры, требуемые статьёй 19 закона № 152-ФЗ.

При этом мы честно скажем: абсолютной защиты в интернете не существует. Мы делаем всё разумное, но не можем дать гарантию от любых мыслимых происшествий.

11. Дети

Сайт предназначен для взрослых и не адресован детям. Мы не собираем сведения о несовершеннолетних осознанно. Если вы родитель и полагаете, что ребёнок передал нам данные, напишите — мы их удалим.

12. Изменения политики

Если мы поменяем состав собираемых данных или способы их обработки, мы обновим этот документ и поставим новую дату редакции наверху страницы. Существенные изменения мы покажем в уведомлении на сайте, а согласие на статистику при необходимости спросим заново.

This notice explains what we learn about people who visit formabureau.com, why we need it and what you can do about it. We have tried to write it in plain language, but it is still a formal document: it is our privacy notice under the General Data Protection Regulation (EU) 2016/679.

1. Who is responsible

The controller of your personal data is Forma Design Bureau, an independent design studio run by Ivan Usanov.

For anything to do with your data, write to hey@formabureau.com — this is the contact point for every request described in section 8. We reply within one working day, and within the statutory deadline for formal requests. If you need our full registration details or a postal address, ask and we will send them.

2. What we collect

There are no sign-up, order or contact forms on this site. We never ask you to type in your name, phone number or address, and we do not collect such details automatically.

We process only what your browser sends by itself when it asks for a page:

• the IP address the request came from;
• your browser and operating system;
• the page you opened and the page you came from;
• the date and time of the request.

This goes into the web server log. Separately, and only if you agree to it, we run visitor statistics — see section 5.

If you email us or write on Telegram, we receive your address or username and whatever you wrote. You give us this yourself, and we use it purely to reply.

3. Why we process it, and on what legal basis

We make no automated decisions that affect you and we do not profile you.

4. What is stored on your device

The site sets no cookies of its own. It uses your browser's local storage, and puts exactly two things there:

• forma_lang — the language you chose;
• forma_cookies_ok — your answer about statistics.

Both stay on your device and are never sent to us. Both are strictly necessary to provide what you asked for, which is why we do not ask separate permission for them. If you consent to statistics, Google Analytics will set cookies of its own, described below.

You can clear all of it by deleting site data in your browser settings. Nothing will break — the site will simply ask about language and statistics again.

5. Visitor statistics

We use Google Analytics, a service of Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland), which acts as our processor.

Nothing loads until you say yes. Until you press "Accept", not a single request goes to Google and no data about you leaves this site. If you press "Decline", the script is never loaded at all.

If you do consent, Google Analytics receives a randomly generated identifier for your browser, a truncated IP address, which pages you viewed and what device you used. We have IP anonymisation switched on, so your full address never reaches Google. Data may be transferred to Google LLC in the United States.

Transfers outside the EU. Google LLC is certified under the EU–US Data Privacy Framework, which the European Commission recognised as providing an adequate level of protection in its decision of 10 July 2023. Google also applies the Commission's Standard Contractual Clauses as an additional safeguard. If you would rather your data did not go to the United States at all, simply decline the statistics — the site works exactly the same.

Withdrawing consent is as easy as giving it and has no effect on what was lawful beforehand. Delete the site data in your browser and the notice will appear again, so you can answer differently. You can also install Google's opt-out add-on, which switches statistics off across every site at once.

6. Who else sees your data

We do not sell your data and do not share it, apart from the following.

• Hosting. Soluciones Corporativas IP, S.L. (DonDominio), Spain — the servers keeping the logs. Data stays within the EU.
• Statistics. Google Ireland Limited and Google LLC — only with your consent and only as described in section 5.
• Authorities. Where we are legally obliged to hand something over.

There is nobody else. Fonts, images and scripts are served from our own server, so during ordinary browsing your device contacts nothing except formabureau.com.

7. How long we keep it

• Server logs — up to 6 months, then deleted.
• Statistics — 14 months, after which Google deletes them automatically.
• Correspondence — for as long as the matter is live, plus 3 years after the last message where a contract came of it.
• Entries in your browser — until you delete them.

8. Your rights

Under the GDPR you have the right to:

• access your data and receive a copy (Art. 15);
• rectify anything inaccurate or incomplete (Art. 16);
• erasure — to be forgotten (Art. 17);
• restrict processing (Art. 18);
• portability — receive your data in a machine-readable form (Art. 20);
• object to processing based on legitimate interests (Art. 21);
• withdraw consent at any time (Art. 7(3));
• complain to a supervisory authority (Art. 77).

To use any of these, write to hey@formabureau.com. We answer within one month and free of charge. If your request is complicated we may take up to two months longer, but we will tell you within the first month and explain why. We may ask you to confirm who you are, but only as far as is needed to avoid handing your data to someone else.

You may complain to the data protection authority of the EU country where you live or work. If you are in Spain, that is the Agencia Española de Protección de Datos, aepd.es. We would appreciate the chance to put things right first, but it is your call and you do not have to come to us at all.

9. How we protect your data

The site runs over HTTPS. Internal sections are password-protected. Only the people in the studio who need server access have it. We take the technical and organisational measures required by Article 32.

That said, no system on the internet is perfectly secure. We do what is reasonable; we cannot promise the impossible.

10. Children

This site is for adults and is not aimed at children. We do not knowingly collect data about anyone under 16. If you are a parent and believe your child has sent us something, write to us and we will delete it.

11. Changes

If we change what we collect or what we do with it, we will update this document and change the version date at the top. We will announce anything substantial in a notice on the site, and where the law requires it we will ask for your consent again.

Este documento explica qué sabemos de quienes visitan formabureau.com, para qué lo necesitamos y qué puede hacer usted al respecto. Hemos intentado escribirlo en lenguaje llano, pero sigue siendo un documento formal: es nuestra política de privacidad conforme al Reglamento General de Protección de Datos (UE) 2016/679.

1. Quién es el responsable

El responsable del tratamiento es Forma Design Bureau, un estudio de diseño independiente dirigido por Iván Usánov.

Para cualquier asunto relacionado con sus datos, escriba a hey@formabureau.com — es el punto de contacto para todas las solicitudes del apartado 8. Respondemos en un día laborable, y dentro del plazo legal cuando se trata de solicitudes formales. Si necesita nuestros datos registrales completos o una dirección postal, pídalos y se los enviaremos.

2. Qué recogemos

El sitio no tiene formularios de registro, pedido ni contacto. Nunca le pedimos su nombre, teléfono o dirección, ni recogemos esos datos automáticamente.

Solo tratamos lo que su navegador envía por sí mismo al pedir una página:

• la dirección IP desde la que llega la petición;
• su navegador y sistema operativo;
• la página que abrió y aquella desde la que llegó;
• la fecha y la hora de la petición.

Todo ello queda en el registro del servidor. Aparte, y solo si usted lo consiente, funcionan las estadísticas de visitas — véase el apartado 5.

Si nos escribe por correo o por Telegram, recibimos su dirección o nombre de usuario y lo que nos haya escrito. Usted nos lo facilita voluntariamente y lo usamos únicamente para responderle.

3. Para qué lo tratamos y con qué base jurídica

No tomamos decisiones automatizadas que le afecten ni elaboramos perfiles.

4. Qué se guarda en su dispositivo

El sitio no instala cookies propias. Utiliza el almacenamiento local del navegador y guarda exactamente dos cosas:

• forma_lang — el idioma que eligió;
• forma_cookies_ok — su respuesta sobre las estadísticas.

Ambas permanecen en su dispositivo y nunca se nos envían. Ambas son estrictamente necesarias para prestar lo que usted pidió, por lo que no solicitamos permiso aparte. Si consiente las estadísticas, Google Analytics instalará cookies propias, descritas más abajo.

Puede borrarlo todo eliminando los datos del sitio en los ajustes del navegador. No se romperá nada: el sitio volverá a preguntarle por el idioma y las estadísticas.

5. Estadísticas de visitas

Usamos Google Analytics, servicio de Google Ireland Limited (Gordon House, Barrow Street, Dublín 4, Irlanda), que actúa como encargado del tratamiento.

No se carga nada hasta que usted acepte. Mientras no pulse «Aceptar», no se envía ni una sola petición a Google y ningún dato suyo sale de este sitio. Si pulsa «Rechazar», el script no llega a cargarse nunca.

Si consiente, Google Analytics recibe un identificador aleatorio de su navegador, una dirección IP truncada, las páginas que vio y el dispositivo que usó. Tenemos activada la anonimización de IP, de modo que su dirección completa nunca llega a Google. Los datos pueden transferirse a Google LLC en Estados Unidos.

Transferencias fuera de la UE. Google LLC está certificada en el Marco de Privacidad de Datos UE–EE. UU., que la Comisión Europea reconoció como nivel adecuado de protección en su decisión de 10 de julio de 2023. Google aplica además las Cláusulas Contractuales Tipo como garantía adicional. Si prefiere que sus datos no salgan hacia Estados Unidos, basta con rechazar las estadísticas: el sitio funciona exactamente igual.

Retirar el consentimiento es tan sencillo como darlo y no afecta a la licitud del tratamiento anterior. Borre los datos del sitio en su navegador y el aviso volverá a aparecer para que responda de otro modo. También puede instalar el complemento de inhabilitación de Google, que desactiva las estadísticas en todos los sitios a la vez.

6. Quién más ve sus datos

No vendemos sus datos ni los cedemos, salvo en los casos siguientes.

• Alojamiento. Soluciones Corporativas IP, S.L. (DonDominio), España — los servidores que guardan los registros. Los datos permanecen en la UE.
• Estadísticas. Google Ireland Limited y Google LLC — solo con su consentimiento y solo en los términos del apartado 5.
• Autoridades. Cuando exista obligación legal de facilitarlos.

No hay nadie más. Las tipografías, las imágenes y los scripts se sirven desde nuestro propio servidor, de modo que al navegar con normalidad su dispositivo no contacta con nada salvo formabureau.com.

7. Cuánto tiempo los conservamos

• Registros del servidor — hasta 6 meses, después se eliminan.
• Estadísticas — 14 meses, transcurridos los cuales Google los borra automáticamente.
• Correspondencia — mientras el asunto siga vivo, más 3 años desde el último mensaje si dio lugar a un contrato.
• Entradas en su navegador — hasta que usted las borre.

8. Sus derechos

El RGPD le reconoce el derecho a:

• acceso a sus datos y a obtener una copia (art. 15);
• rectificación de lo inexacto o incompleto (art. 16);
• supresión — al olvido (art. 17);
• limitación del tratamiento (art. 18);
• portabilidad — recibir sus datos en formato legible por máquina (art. 20);
• oposición al tratamiento basado en interés legítimo (art. 21);
• retirar el consentimiento en cualquier momento (art. 7.3);
• reclamar ante una autoridad de control (art. 77).

Para ejercer cualquiera de ellos, escriba a hey@formabureau.com. Respondemos en un mes y de forma gratuita. Si la solicitud es compleja podemos tardar hasta dos meses más, pero se lo comunicaremos dentro del primer mes explicando el motivo. Podemos pedirle que acredite su identidad, pero solo en la medida necesaria para no entregar sus datos a un tercero.

Puede reclamar ante la autoridad de protección de datos del país de la UE donde resida o trabaje. En España es la Agencia Española de Protección de Datos, aepd.es. Agradeceríamos la oportunidad de resolverlo antes, pero la decisión es suya y no está obligado a dirigirse a nosotros.

9. Cómo protegemos sus datos

El sitio funciona sobre HTTPS. Las secciones internas están protegidas con contraseña. Solo tienen acceso al servidor las personas del estudio que lo necesitan. Aplicamos las medidas técnicas y organizativas exigidas por el artículo 32.

Dicho esto, ningún sistema en internet es perfectamente seguro. Hacemos lo razonable; no podemos prometer lo imposible.

10. Menores

Este sitio se dirige a adultos y no está pensado para menores. No recogemos conscientemente datos de menores de 16 años. Si es usted madre, padre o tutor y cree que un menor nos ha facilitado algo, escríbanos y lo eliminaremos.

11. Cambios

Si cambiamos lo que recogemos o lo que hacemos con ello, actualizaremos este documento y modificaremos la fecha de versión que figura arriba. Anunciaremos en el sitio cualquier cambio sustancial y, cuando la ley lo exija, volveremos a pedir su consentimiento.
